International and Domestic Arbitration
The arbitration clause is drafted in fifteen minutes and then governs everything that happens for the next four years.
What we do
We advise on the clause, conduct the reference and litigate what follows. Institutional and ad hoc arbitration seated in India and abroad. Interim measures under Section 9 and before emergency arbitrators. Appointment applications under Section 11. Conduct of the reference, including document production, witness preparation and expert evidence. Challenges to awards under Section 34 and appeals under Section 37, where the ground is narrow and the drafting has to be precise. Enforcement of domestic awards, and of foreign awards under Part II and the New York Convention, together with the public policy objections that are routinely raised and rarely succeed. We also act as India counsel to parties represented by foreign firms in international arbitrations with an Indian element, handling the Indian court applications, the Indian law issues and the enforcement while the lead firm runs the reference.
